EU Regulatory Framework
β No AOC required for Outermost Airlines
For intra-EU wet lease (EU operator to Outermost EU/OMR), mutual AOC recognition applies. No prior DGAC approval required for the lease structure itself.
Legal obligations:
- Regulation (EC) No 2111/2005: passengers must be informed of the actual carrier (ACMI operator) at time of booking
- Transparency: mandatory mention "Operated by [ACMI Name]" on all sales channels
- Insurance: liability coverage provided by ACMI (Reg 785/2004)
- Passenger rights: operational liability remains with ACMI, but Outermost Airlines is the commercial point of contact
If non-EU operator:
If the ACMI is outside the EU, Outermost Airlines must obtain prior DGAC approval (max 7 months, renewable). Prioritise an EU-AOC operator to avoid this constraint.
